Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Wanderfy website located at https://www.wanderfy.travel/ and any related services (collectively, the "Service") operated by Wanderfy ("Wanderfy", "we", "us" or "our").

If a resolution cannot be reached through negotiation, then, to the extent permitted by law:

  • The dispute shall be submitted to binding arbitration in accordance with the Arbitration Act of Ontario, the Arbitration Act of Canada, or an equivalent provincial arbitration body, as applicable.

  • If arbitration is not possible or is deemed unenforceable, you agree to submit to the exclusive jurisdiction and venue of the provincial or federal courts located in Ontario, Canada.

You agree that any such dispute will be brought on an individual basis only and not as a class action or other representative proceeding.

9. User Content (Comments, Reviews, and Emails)

You may be permitted to post, submit, or transmit content through the Service, such as comments, reviews, messages, or other materials ("User Content"). By submitting User Content, you agree that:

  • User Content must not be unlawful, obscene, defamatory, threatening, harassing, hateful, infringing on intellectual property rights, invasive of privacy, or otherwise harmful to third parties.

  • User Content must be free of viruses, malware, spam, political campaigning, or unsolicited commercial messages.

We reserve the right, but not the obligation, to monitor, edit, or remove User Content at our sole discretion.

By posting or submitting User Content, you grant Wanderfy a non-exclusive, worldwide, royalty-free, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and perform such content in any media now known or later developed, for any legitimate business purpose.

You represent and warrant that:

  • You own or have the necessary rights to submit the User Content and grant the license above.

  • Your User Content does not violate these Terms or any rights of third parties.

10. Limitation of Liability

To the fullest extent permitted by applicable law:

  • Wanderfy, its affiliates, and their respective officers, employees, agents, partners, and contractors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Without limiting the foregoing, Wanderfy will not be liable for any damages, losses, or injuries resulting from:

  • Your access to, use of, or inability to access or use the Service.

  • Any conduct or content of any third party on or through the Service.

  • Any unauthorized access to, use of, or alteration of your transmissions or content.

  • Your reliance on any information or content obtained through the Service, which is provided "as is" and for general information purposes only.

  • Any events beyond our reasonable control, including but not limited to technical failures, interruptions, system downtime, cyberattacks, natural disasters, or acts of third parties.

If, notwithstanding the above, Wanderfy is found liable to you for any damage or loss arising out of or in any way connected with your use of the Service, our aggregate liability shall in no event exceed the greater of (i) the total amount you have paid to Wanderfy (if any) during the six (6) months prior to the event giving rise to the claim, or (ii) fifty Canadian dollars (CAD $50).

11. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis, without any warranties of any kind, whether express, implied, or statutory, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, non-infringement, and title.

Wanderfy does not warrant that:

  • The Service will be uninterrupted, secure, or error-free.

  • Any defects or errors will be corrected.

  • The Service or the servers that make it available are free of viruses or other harmful components.

  • The information or content obtained through the Service will be accurate, complete, or reliable.

You use the Service at your own risk.

12. Termination

We may, at our sole discretion and without prior notice, suspend or terminate your access to all or part of the Service for any reason, including but not limited to:

  • A breach or suspected breach of these Terms.

  • Illegal, fraudulent, or abusive behavior.

  • Security or technical issues.

Upon termination:

  • Your right to use the Service will immediately cease.

  • We may retain or delete any data or content associated with your use of the Service, subject to our legal obligations and our Privacy Policy.

Sections of these Terms that by their nature should survive termination (including but not limited to intellectual property, user content license, limitation of liability, dispute resolution, and governing law) will continue to apply after termination.
